COPPO v. CONNAUGHT LABORATORIES

Plaintiff, an infant, was administered a DPT vaccine. He subsequently developed an adverse reaction, which resulted in permanent brain damage. During discovery, an issue arose as to whether the drug administered to plaintiff was manufactured by Connaught Laboratories. In order to diffuse the obvious sympathy involved in this case, Mr. Winterman convinced the judge to bifurcate the action and allow the issue of product identification to be tried separately from liability and damages. The case was tried by Dick Denver of the Los Angeles office of Denver & Dodd, and by Neil A. Cook of the Law Firm of Strom, Buller & Livingston. Both firms specialize in DPT litigation. A Concord, California jury rendered a verdict in favor of Connaught Laboratories.
