DESFULI v. LIM, M.D.

This case involved a treating physician and radiologist’s failure to diagnose breast cancer. The treating physician testified he did perform a complete examination and appropriately and timely referred the patient for a mammogram. During the relevant time period, the patient allegedly complained of breast lumps that were ignored by Dr. Lim. The jury agreed with the defense presentation of the case and found that the earlier mammograms were not suspicious, the clinical evaluations were appropriate and by the time the breast lesions were clinically apparent, her disease was fatal. Significantly, the jury returned a defense verdict on behalf of the patient, an employed mother of two, on Christmas Eve. The verdict was unanimous.
