HERNANDEZ GOMEZ v. VOLKSWAGEN

Mr. Winterman was part of the team that successfully established new appellate law in the State of Arizona. This case, which involved the issue of federal preemption, was argued once before the United States Supreme Court and twice before the Arizona Supreme Court. Ultimately, Volkswagen prevailed when the Arizona Supreme Court let stand a decision by the Arizona Court of Appeal finding federal preemption. The issue presented to the court was whether the Federal Motor Vehicle Safety Standards relating to passive seat belt systems preempted state court laws pertaining to product defects.
