McDONALD v. VOLKSWAGEN

This product liability case involved a 37-year-old man who was rendered an incomplete paraplegic when his 1986 Volkswagen Jetta collided with a 1987 Chrysler 5th Avenue. Plaintiff sustained a herniated aorta which required immediately surgery. He contended that his Jetta was not crashworthy and that it did not have a properly designed energy absorbing steering wheel. Plaintiff demanded $4,200,000 in settlement. After a 4-week trial the jury returned a unanimous defense verdict. Plaintiff waived his appeal in exchange for Volkswagen’s waiver of costs.
