REYES AND PERALTA v. VOLKSWAGEN

This case involved a Volkswagen Van that was involved in a solo vehicle accident and overturned. The three plaintiffs were driving to work and went through a tight curve. Suddenly, without apparent explanation, the Van was alleged to have rolled over onto its side, and was struck by an oncoming vehicle. The driver was killed; her daughter seated next to her was severely injured and suffered permanent orthopedic injuries as well as head trauma. The rear seat passenger was rendered a permanent paraplegic. Plaintiffs contended that the Van was defective in design, that the center of gravity was too high and that the track width was too narrow, causing it to have a propensity to roll over during a sharp turning maneuver.

Plaintiffs were represented by Philip Marone, former President of the Association of Southern California Defense Counsel. A defense verdict was rendered after a 24 day trial.
